This is the Second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 103/2025 registered at Police Chowki – Balangi, Police Station – Raghunathnagar, District – Balrampur-Ramanujganj (C.G.), for the offence punishable under Sections 70(B), 74, 331(6) of BNS and Sections 4 & 6 of POCSO Act. 2. The first bail application of the applicant was dismissed on Digitally signed by HEERA LAL SAHU Date: 2026.07.02 10:11:19 +0530 2 merit on 28.02.2026 in MCRC No. 399/2026. 3. As per the prosecution’s case, on 29.07.2025, the victim-1, who is sister-in-law (Bhabhi) of victim-2, (victim-2 aged about 15-16 years) lodged a report alleging that on 08.07.2025, she and victim-2 stayed in the house, and her (victim -1) husband was out of house in the night, at that time, the applicant along with co-accused Rakesh Prajapati entered the house. Further, it is alleged against the applicant that the applicant caught her (victim-1-major victim) hand and molested her. Based on this, offence has been registered against the present applicant. 4. Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in this case. He further submits that there is an unexplained delay of 21 days in lodging the FIR. At the time of the incident, the mother-in-law and the father-in-law of the victim-1 were present at the house, but the victim did not raise an alarm. There was a monetary transaction between the applicant and the husband of the victim-1. Another co-accused person, namely Rakesh Prajapati, has already been granted bail by this Court on 04.05.2026 in MCRC No. 3726/2026. The applicant is in jail since 31.07.2025, only 2 witnesses out of 13 have been examined till date, and the trial is likely to take considerable time to conclude. Therefore, he prays for the grant of regular bail to the applicant. 5. On the other hand, learned counsel for the State opposed the bail application. 6. The victim along with her younger brother appeared through 3 V.C. from concerned DLSA and raised objection to grant of bail to the applicant. 7. I have heard learned counsel appearing for the parties and perused the case diary. 8. Considering the facts and circumstances of the case and also considering the fact that the applicant is in custody since 31.07.2025, and the trial is likely to take considerable time, at this stage, I am inclined to release the applicant on bail. 9. Accordingly, the application is allowed and it is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the trial Court. Applicant is directed to appear before the trial Court on each and every date to be given to him by the said Court till disposal of the trial. It is made clear that any observation made by this Court in this order shall not affect the trial of the case. 10.
