JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.543/2025, pending before the II Additional Chief Judicial Magistrate, Bangalore Rural District, Bengaluru, for the offences under Sections 406, 465, 467, 468, 471, 420, 114 read with Section 34 of the IPC. 2. Heard Sri. M.G. Raghavendra, learned counsel appearing for the petitioner, Smt. Deepthi Alva, learned HCGPP - 3 - HC-KAR NC: 2026:KHC:31877 CRL.P No. 8894 of 2026 appearing for respondent No.1, Smt. K. Vijayalakshmi, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo/Application of compromise along with affidavits. The Joint Memo/Application of compromise reads as follows: “MEMORANDUM OF JOINT MEMO / APPLICATION OF COMPROMISE FILED ON BEHALF OF PETITIONER AND 2ND RESPONDENT UNDER SECTION 359 READ WITH SECTION 528 OF BNSS, 2023. The Petitioner and Respondent No.2/ De- facto complainant above named begs to submit as follows:- 1) The Respondent No.2/De-facto Complainant is the Natural Biological Mother of Petitioner. 2) On 26.01.2024 the De-facto Complainant filed the complaint against the Petitioner and others before Thalaghattapura Police Station, Bangalore. 3) On 30.01.2024 the Thalaghattapura Police registered a case against Petitioner and others FIR in Crime No.0033/2024 alleging the offences punishable under section 406, 465, 467, 468, 471, 420 read with Section 34 of I.P.C. 4) On 10.01.2025 the Respondent No.1 filed charge sheet against Petitioner and others, alleging the offences punishable under section 406, 465, 467, 468, 471, 420, 114 read with section 34 of I.P.C. and case is registered as - 4 - HC-KAR NC: 2026:KHC:31877 CRL.P No. 8894 of 2026 C.C.No.543/2025, before II Additional Chief Judicial Magistrate, Bangalore Rural District, Bangalore. 5) On 24.03.2025 the De-facto Complaint along with Petitioner have jointly approached the Central Bank of India for settlement of the loan amount. To that effect, a One Time Settlement ("OTS for short) dated:24.03.2025 and same is accepted by the Central Bank of India and the Bank has issued Compromise Approval Letter dated:24.03.2025 by stating that they have no objection to release the security documents i.e., title deeds and gift deed which are in the safe custody of II Additional Chief Judicial Magistrate Court at Bangalore Rural District, Bangalore. The Copy of the Compromise of Approval Letter dated:24.03.2025 is herewith produced for kind perusal of this Hon'ble Court and mentioned as Document No.1. 6) On 16.04.2025 the OTS amount was paid by De-facto Complainant with love and affection towards her son i.e., Petitioner. On fulfilment of entire loan liability the Central Bank of India has issued No Due Certificate in favour of the De- facto complainant. The Copy of the No Due Certificate is herewith produced for kind perusal of this Hon'ble Court and mentioned as Document No.2. 7) On 22.06.2026 the petitioner filed a Criminal Petition before this Hon'ble Court seeking Quash the Complaint and Charge sheet and Entire Proceedings in C.C.No.543/2025 pending on the file of II Additional Chief Judicial Magistrate, Bangalore Rural District, Bangalore. 8) On 23.06.2026 with the intervention of the well-wishers, friends and family members the petitioner and De-facto Complainant have jointly entered in to between Memorandum of Compromise Cum Understanding Deed and mutually agreed that the De-facto complainant will not contest further and she will withdraw the case by giving full and free consent to Quash the complaint, FIR, Charge Sheet and proceedings of the II Additional Chief Judicial Magistrate, Bangalore Rural District, Bangalore in C.C.No.543/2025. The Copy of Memorandum of Compromise Cum Understanding is herewith produced for kind perusal of this Hon'ble Court and mentioned as Document No.3. 9) The Counsel for petitioner and De-facto Complaint are jointly herewith submitting to citation passed by Supreme - 5 - HC-KAR NC: 2026:KHC:31877 CRL.P No. 8894 of 2026 Court of India in A) Special Leave Petition (Criminal) No.4353/2018, passed by Hon'ble Justice B.R.Gavai, between K.Bharathi Devi and another Versus State of Telangana & another, REPORTABLE. B) Criminal Appeal No.1489/2012 Connected with 1488/2012, passed by Hon'ble Justice Surya Kant, between Ramgopal & another Versus the State of Madhya Pradesh and Krishnappa & others versus State of Karnataka REPORTABLE. The Copies of the Citations are herewith produced for kind perusal of this Hon'ble Court and mentioned as Document No.4 & 5. 10) The charge sheeted alleged offences are not a heinous crime. The Parties have settled disputes voluntarily, without coercion, and often to restore relationship and social harmony, the matter particularly civil in nature. Both the parties have no objection to Quash the FIR, Complaint, Charge sheet and further proceedings of II Additional Chief Judicial Magistrate Court at Bangalore Rural District, Bangalore in C.C.No.543/2025 by closing this case. The 2nd Respondent/De- facto Complainant states that she is not interested in prosecuting the Petitioner and others further. 11) This joint petition/application is filed without any coercion, fear or undue influence, wilfully free consented by both parties. 12) If this petition/application is not allowed the parties will be put to irreparable loss and hardship which cannot be compensate in any manner. The continuing the criminal proceedings would be a 'futile exercise" and cause further abuse of legal process. Quashing of the FIR and Complaint will not impact on public or society at large. PRAYER It is, therefore Both the parties have jointly prayed that this Hon'ble Court may kindly be pleased to record this joint compromise Petition and praying permission of this Hon'ble Court to compound the offences by exercising the power of Hon'ble High Court of Karnataka under section 528 of BNSS, in C.C.No.543/2025 for alleged offences punishable under section 406, 465, 467, 468, 471,420, 114 read with section 34 of I.P.C, which is pending on the file of II Additional Chief Judicial Magistrate Court at Bangalore Rural District, - 6 - HC-KAR NC: 2026:KHC:31877 CRL.P No. 8894 of 2026 Bangalore, vide Annexure - "D" to prevent abuse of the process of law and secure the ends of justice.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Joint Memo/Application of compromise being filed along with the affidavits by the parties to the lis and offences not being against the State, I deem it appropriate to accept the said Joint Memo/Application of compromise and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
