The petitioner alleges violation of judgment dated 16.09.2025 passed by learned Principal Judge, Family Court, Kangra at Dharamshala in G.W. Case No. 37-D/II/2019. 2. In exercise of powers conferred by Section 23 of the Contempt of Courts Act, 1971 and all other powers enabling it in this behalf, the High Court of Himachal Pradesh has framed Contempt of Court (Himachal Pradesh) Rules, 1996. Portion C of Part II of the aforesaid Rules is with the heading ‘Civil Contempt’. Rule 9 thereunder, being relevant, is extracted herein under: “9. In the case of a civil contempt other than a contempt referred to in Section 14, the High Court may take action:- (a) On its own motion; or 1 Whether reporters of the local papers may be allowed to see the judgment? 2 (b) On a petition presented by the party aggrieved; or (c) In the case of any civil contempt of a Subordinate Court, on a reference made to it by that Court. The Subordinate Court will make a reference to the High Court in accordance with Rule 8 of these rules.” 3. In view of the above, the present contempt petition is not maintainable. In case of any civil contempt of learned court below, action can be taken for the said contempt only on a reference to be made by the concerned court to this court.
