For Petitioner : Mr.C.Karthikeyan For Respondents : Mr.A.Thiruvadi Kumar, Additional Public Prosecutor ____________ https://www.mhc.tn.gov.in/judis W.P.CRl..(MD).No.2206 of 2026 O R D E R [Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the proceedings of the third respondent made in No.RO-TRY/112/2026-CA, dated 27.03.2026 and for a consequential direction to the respondents to grant 28 days ordinary leave to the convict without police escort. 2. Heard the learned counsel on either side. 3. The petitioner is the son of the life convict, who is presently serving sentence at Central Prison, Trichy. The petitioner made a representation seeking for 28 days ordinary leave. The same came to be rejected by the third respondent through the impugned proceedings dated 27.03.2026. Aggrieved by the same, the present writ petition has been filed before this Court. 4. On carefully going through the impugned proceedings dated 27.03.2026, it is seen that the only reason that has been assigned against the convict is that when he returned back to the prison, he was under the ____________ https://www.mhc.tn.gov.in/judis W.P.CRl..(MD).No.2206 of 2026 influence of alcohol. Since the same was against the Rules, the ordinary leave was not granted to the convict. 5. The learned Additional Public Prosecutor produced the report submitted by the Probation Officer to the third respondent and it is seen that the Probation Officer had informed that there is likelihood of the petitioner getting into a tiff with his father and it may lead to adverse consequences. 6. This Court carefully considered the submissions made on either side and the order passed by the third respondent and the written instructions received from the fifth respondent. 7. The convict has already served sentence for fourteen years. The petitioner, who is the son, had sought for ordinary leave on the ground that the convict's wife is suffering from cardiac issues and she needs inpatient care and hence, funds will have to be arranged for her treatment. The third respondent has rejected the representation only on the ground that the convict while returning back to the prison after the earlier leave was granted was under the influence of alcohol. ____________ https://www.mhc.tn.gov.in/judis W.P.CRl..(MD).No.2206 of 2026 8. In our considered view, considering the period that has been undergone by the convict and considering the reasons assigned to seek for ordinary leave, the reasons stated in the impugned order will not come in the way of the authority granting 28 days ordinary leave to the convict. 9. In the light of the above discussion, the impugned proceedings of the third respondent made in No.RO-TRY/112/2026-CA, dated 27.03.2026 is hereby set aside. There shall be a direction to the third respondent to grant 28 days ordinary leave to the convict without police escort. The convict shall report before the fifth respondent daily at 06.00 p.m., during the entire ordinary leave period. Apart from that condition, the convict is permitted to execute the sureties before the Superintendent of Prison, Trichy, instead of executing the sureties before the Tahsildar and two sureties shall be the family members of the detenu.
