(ORAL) By way of this petition filed under Section 482 BNSS, 2023, prayer is made for grant of anticipatory bail in case FIR No.744 dated 23.12.2025, under Sections 109 of BNS, 2023 (earlier U/s 307 of IPC), U/s 3(5) of BNS, 2023 (earlier U/s 34 of IPC), U/s 115(2) of BNS, 2023 (earlier U/s 323 of IPC), U/s 351 of BNS, 2023 (earlier U/s 506 of IPC), Police Station Sadar Thanesar, District Kurukshetra. Petitioner-Aryan claims to be juvenile. It is alleged that on the date of alleged occurrence, i.e. 23.12.2025, he was 17 years 10 months and 23 days old. He had earlier applied for anticipatory bail, which had been declined by the Court of Sessions vide order dated 02.06.2026 (Annexure P- 5). However, it is conceded by learned counsel for the petitioner that neither before the trial Court nor before the Court of Sessions, it was disclosed that the petitioner was a juvenile. After arguing the matter at some length, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to move an appropriate application before the concerned trial Court for seeking bail on the ground of his juvenility.
