Accused in Crime No.103/2026 registered by Hunusur Town Police Station, Mysuru District, for the offences punishable under Sections 352, 109, 121 of BNS, 2023 and Section 2 of Prevention of Destruction and Loss of Property Act, 1981, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.103/2026 was registered by Hunusur Town Police Station, Mysuru District, for the aforesaid offences against the petitioner herein based on the first information dated 10.04.2026 received from Krishnashetty - Police Officer attached to Hunusur Town Police Station. Petitioner herein was arrested on 10.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5112/2026 was rejected on 02.05.2026. Therefore, petitioner is before this Court. 4. Perusal of the material on record would go to show that on receipt of credible information that the petitioner was - 3 - HC-KAR NC: 2026:KHC:32231 CRL.P No. 7325 of 2026 quarrelling with one Kiran, the first informant along with another police constable allegedly went to the spot where the petitioner was quarrelling with the aforesaid Kiran. After seeing the police, the petitioner allegedly abused the first informant using filthy language and also tried to assault him with a stone. In the alleged incident, the first informant has undisputedly suffered only a minor injury. It is further alleged that after petitioner was brought to the police station, he allegedly dashed his head as against a glass pan in the police station and as a result, the said glass pan broke and the petitioner had sustained injury in the said incident. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. 5. Petitioner has no other criminal antecedents. He is in custody from 10.04.2026. Major portion of the investigation is completed. The first informant has suffered only minor injury in the alleged incident. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: - 4 - HC-KAR NC: 2026:KHC:32231 CRL.P No. 7325 of 2026 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.103/2026 registered by Hunusur Town Police Station, Mysuru District, for the offences punishable under Sections 352, 109, 121 of BNS, 2023 and Section 2 of Prevention of Destruction and Loss of Property Act, 1981, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of - 5 - HC-KAR NC: 2026:KHC:32231 CRL.P No. 7325 of 2026 the said Court until the case registered against him is disposed off; f) Petitioner shall mark his attendance before the Station House Officer, Hunusur Town Police Station, Mysuru District, on the first and third Sunday of each month between 10.00 a.m. and 1.00 p.m. till the charge sheet is filed in the present case.
