In the matter of : Minakshe Ghosh
… Petitioner(s)
Mr. Anjan Bhattacharya Ms. Anita Shaw Ms. Seems Thakur
… for the Petitioner(s)
Mr. Debojyoti Deb Ms. Anushka Ghosh
… for the State-respondent(s)
Learned advocate for the petitioner submits that the petitioner is in custody for two years two months and till date only charges have been framed and witness action is yet to commence. It has been contended that the petitioner was never named by the victim and she has been falsely implicated in the instant case on the basis of embezzled accusations. Therefore, learned advocate prays that the petitioner may be released on bail on any stringent condition. Learned advocate for the State opposes the prayer for bail and submits that the present petitioner [Minakshe Ghosh] has also been referred to as Soma which would be
2 evident from the statement of the victim under Section 180 of the BNSS. Learned advocate also emphasizes that so far as the complicity of the present accused is concerned, she is thickly connected with the alleged offence. Having regard to the manner in which the exploitation has taken place in the present case, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 214 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
