IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH **** 108 CRM-M-33581-2026 Date of Decision.:11.06.2026 Kuljinder Singh
…..Pe22oner Vs. State of Punjab .….Respondent
CORAM:- HON'BLE MR. JUSTICE DEEPAK GUPTA Present:- Mr. Bhrigu Agnihotri, Advocate for the peoner. **** DEEPAK GUPTA, J. (ORAL) The peoner has approached this Court under Secon 482 of the Bharaya Nagarik Suraksha Sanhita, 2023, seeking the concession of ancipatory bail in case FIR No.107 dated 09.05.2026 registered under Secons 296, 75, 78, 79 and 285 of the Bharaya Nyaya Sanhita, 2023 at Police Staon City Khanna, District Ludhiana.
2. As per the allegaons contained in the FIR, the complaint was lodged by Jasvir Kaur, Kir, Sukhjit Kaur, Baljit Kaur and Sukhrajdeep Kaur. It is alleged that the peoner, who resides in a house situated at the end of the street, habitually used to stand in the street and make obscene gestures towards women, including eye-winking and other indecent acts. He is further alleged to have followed and harassed the women residing in the locality. The specific allegaon is that on 07.05.2026, the peoner again made obscene gestures towards the complainants and also obstructed the common passage by parking his vehicle in a manner that blocked access to the neighbourhood road.

3.
Learned counsel for the peoner contends that the peoner has been falsely implicated. It is argued that the peoner had earlier instuted a civil suit for injuncon against one Jagdish Kumar, which was subsequently withdrawn. Therea;er, Jagdish Kumar allegedly iniated rent proceedings against the peoner and, owing to the said dispute, has engineered the registraon of the present FIR through the complainants. 4. The aforesaid submission does not impress this Court. Upon a specific query, learned counsel for the peoner has been unable to explain as to how all the complainant ladies, who have levelled allegaons of harassment and obscene conduct against the peoner, are connected with Jagdish Kumar or what move they would have to falsely implicate the peoner. Mere existence of a prior civil or rent dispute with a third person, by itself, cannot furnish a valid ground to discard the allegaons made by mulple independent complainants, parcularly at the stage of consideraon of ancipatory bail. 5. It is well se>led that while considering a peon for ancipatory bail, the Court is required to examine the nature and gravity of the allegaons, the role a>ributed to the accused, the necessity of custodial interrogaon and the overall impact of the alleged conduct on society. At this stage, the Court is not expected to undertake a meculous examinaon of the evidence or adjudicate upon the truthfulness of rival claims. 6. In the present case, the allegaons are not of an isolated incident but disclose a pa>ern of conduct involving repeated acts of harassment, stalking, obscene gestures and inmidaon directed towards women residing in the locality. The accusaons have been levelled by several women and prima facie reveal conduct affecng their dignity, privacy and sense of security. Such allegaons cannot be lightly brushed NEETIKA TUTEJA 2026.06.12 15:12 I attest to the accuracy and integrity of this document
CRM-M-33581-2026 -3- aside merely on the plea of false implicaon arising out of a collateral dispute. 7. Having regard to the nature and seriousness of the allegaons, the plurality of complainants, and the absence of any material demonstrang mala fides on their part, this Court is of the considered view that the peoner has failed to make out a case for the exercise of the extraordinary discreonary relief of ancipatory bail. 8. Consequently, finding no merit in the present peon, the same is dismissed.
Nothing observed herein shall be construed as an expression on the merits of the case during trial. (DEEPAK GUPTA) JUDGE June 11, 2024 Neeka Tuteja
