Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 10.1 Hon’ble Court may kindly be pleased to call record in respect of promotion to the post of Principal. 2 10.2 Hon’ble Court may kindly be pleased to direct respondent authority to mention place name of the petitioner in the proper place of gradation list of Lecturer (E-Category) as on 01/04/2023, on the basis of initial appointment. 10.3 Hon’ble Court may kindly be pleased to direct respondent authority to consider the name of petitioner for promotion to the post of Principal. 10.4 Hon’ble Court may kindly be pleased to direct respondent authority to grant monetary benefit to the petitioner from the date, when his junior has been granted promotion. 10.5 Any other relief may also be granted to the Petitioner which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case. 2. At the outset, learned counsel appearing for the petitioner submits that since the petitioner's name was placed below the name of his juniors in the last gradation list for the post of Lecturer (E-Category) prepared on 01.04.2023 and published on 01.06.2023, therefore, his name was not considered for promotion to the post of High School Principal. He further submits that the petitioner has already filed representation for redressal of grievance before respondent No. 2 - Director, Directorate of Public Instructions, Department of School Education, Raipur, but no decision has been taken on it till now. Therefore, he prays that at this stage, this petition may be disposed of granting liberty to the petitioner to file fresh representation for redressal of his grievances and directing the respondent No. 2 to take a decision thereon as expeditiously as possible. 3 3. Learned counsel for the respondents would submit that if the petitioner files fresh representation for redressal of his grievances, then the same shall be considered and decided in accordance with law. 4. I have heard learned counsel for the parties and perused the material placed on record. 5. Having considered limited prayer of the petitioner, without entering into the merits of the case, this petition is disposed of granting liberty to the petitioner to file fresh representation within 15 days from today before respondent No. 2 - Director, Directorate of Public Instructions, Department of School Education, Raipur. In the eventuality of filing such representation, the respondent No. 2 is directed to take a decision on the said representation expeditiously preferably within a period of 90 days from the date of receipt of fresh representation filed by the petitioner in accordance with law. 6. With the aforesaid observation & direction, this petition is disposed of. 7. Pending interlocutory application (s), if any, stands disposed of.
