Kalawati & Others versus Rajender Kumar & Others CMP No. 24316 of 2026 in CMPMO No.463 of 2016 22.09.2026 Present: Mr. Anuj Bali, Advocate, for the
applicant/petitioner. Mr. Mohinder Verma, Advocate, for non- applicants/respondents No.1, 2 and 4. None for respondents No.3 and 5. The above titled petition, filed by the applicants, under Article 227 of the Constitution of India, was allowed, by this Court vide order dated 09.09.2026, by giving the opportunity to the applicants to lead evidence, before the learned trial Court, subject to payment of Rs.50,000/- as costs. Now, by way of the present application, a prayer has been made to reduce/waive off costs, as imposed, by this Court, as, majority of the applicants, are rustic women and are senior citizens. The said prayer, as made in the application, has been opposed by the learned counsel appearing for the non-applicants/respondents No.1,2 and 4, on the ground that, in this case, the petitioners have taken as many as, 12 opportunities to lead evidence. Considering the fact that the majority of the applicants are senior citizens, the application is allowed
and the cost imposed is reduced from Rs.50,000/- to Rs.30,000/-. The application stands disposed of. (Virender Singh) Judge September 22, 2026 (ps)
