This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.349/2019, registered at Police Station Aamanaka, District- Raipur (CG) for the offence punishable under Sections 302, 201, 120(B) of IPC and Sections VASANT KUMAR Digitally signed by VASANT KUMAR Date: 2026.07.01 15:36:47 +0530
2 25 & 27 of the Arms Act. 2. As per prosecution case, on 15.11.2019, an unidentified male dead body was found stuffed inside a plastic sack and floating in the Kharun River near Chandandih. The hands and legs of the deceased were tied, and multiple injuries caused by a sharp edged weapon were found on the body. Upon receiving the information, the police recovered the body and registered the case against unknown persons. During the course of investigation sufficient evidence was found against the applicant and he was arrested on
02.11.2019. 3. Learned counsel for the applicant contended that the applicant is an innocent and has been falsely implicated in the said case. He further contended that the FIR was lodged against the unknown persons and only 05 prosecution witnesses have been examined before the trial Court out of 28 prosecution witnesses. He further contended that the trial has not been concluded and the applicant is in jail since 02.11.2019 and trial will take considerable time for its conclusion, therefore, the applicant may be released on bail. 4. Learned State counsel opposes the submission made by learned counsel for the applicant and would submit that the applicant along with other persons committed murder of the deceased- Krishna Soni and thereafter they thrown his dead body in the
3 Kharun river, therefore, the applicant may not be released on bail. 5. I have heard learned counsel for the parties. 6.
Considering the facts and circumstances of the case, material available on record and looking to the nature and gravity of the offence, this Court is not inclined to grant bail to the applicant. 7. Accordingly, the bail application of the applicant stands rejected. However, the trial Court is directed to expedite the trial and conclude the same within a period of six months from today strictly in accordance with law. 8.
