JUSTICE RAVI V HOSMANI ORAL ORDER Challenging FIR in Crime No.19 of 2019 registered by Chamarajanagar Women Police Station, Chamarajanagar, for offences punishable under Sections 498(A), 323, 506, 114 read with Section 34 of Indian Penal Code, 1860 presently on file of Additional Civil Judge, Senior Division and Chief Judicial Magistrate, Chamarajanagar, this petition is filed. 2. Smt. Pavana B.K. learned counsel appearing for Pratheep K.C., advocate for petitioners submitted that petitioners herein were accused no.2 to 9. It was submitted that petitioners no.7 and 8 were parents-in-law of complainant, while other petitioners were relatives of husband of complainant. It was submitted that marriage of complainant with Nanda Kishore (accused no.1) was solemnized on 23.11.2015. However, marriage did not - 5 - HC-KAR NC: 2026:KHC:31209 CRL.P No. 7705 of 2019 run smoothly and led to filing of complaint impugned herein and Nanda Kishore filing M.C.no.5/2019 before Family Court at Mysuru and there was settlement between complainant and her husband (arrayed as accused no.1 herein). It was further submitted that accused no.1 had filed Crl.P.No.4776/2022 before this Court. Same was allowed on 17.08.2022 and proceedings against accused no.1 quashed. Present proceedings in CC no.6/2020 on file of Additional Senior Civil Judge and CJM., Chamarajanagar were arising from very same complaint. 3. It was further submitted matter was referred for mediation wherein parties had agreed for settlement on 15.02.2022. Terms of settlement were drawn into an agreement under Section 89 of CPC. In view of above, proceedings against other accused could not be continued and sought for allowing petition. 5. In view of above, since proceedings against accused no.1 have been quashed by this Court in Crl.P no.4776/2022 on 17.08.2022, as well as on ground of settlement between parties to this petition on 15.02.2022, continuation of impugned proceedings would be futile and if not, abuse of process of law. Therefore, petition is allowed and proceedings in Cr.no.19/2019 registered by Chamarajanagar Women Police Station, Chamarajanagar, pending on file of Additional Civil Judge, Senior Division and Chief Judicial Magistrate, Chamarajanagar, in so far as petitioners (accused no.2 to 9) stand quashed.
