Upon perusal, it is seen that the said notice has been issued demanding a penalty amount of Rs.2,02,29,977/- and stating that, in the event of non- compliance, further action would be initiated under the Revenue Recovery Act, 1864. 3. The primary ground on which the petitioner challenges the impugned notice is that, as against the assessment and imposition of penalty, the petitioner has already filed W.P.(MD)No.16493 of 2025, and by order dated 19.06.2025, the respondents have been restrained from recovering the said amount until disposal of the said Writ Petition. 4. When the matter came up for hearing, the learned Government Advocate, taking notice on behalf of the respondents, submitted that pursuant to Page No.2 of 5 https://www.mhc.tn.gov.in/judis W.P.(MD)No.10879 of 2026 the directions issued in the Public Interest Litigation in W.P.(MD)No.14078 of 2025, notices were issued, including to the petitioner. 5. I have considered the rival submissions made on either side and perused the materials available on record. 6. In view of the subsisting interim order in favour of the petitioner, the impugned demand ought not to have been issued, insofar as it relates to the amount covered by the said interim order. If the impugned demand pertains to the very same amount, it is for the respondents to suo motu withdraw the impugned notice. 7. If no such communication is issued withdrawing the impugned notice and further coercive steps are pursued, it is open to the petitioner to initiate appropriate contempt proceedings in W.P.(MD)No.16493 of 2025. 8. Accordingly, the Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
