JUSTICE D K SINGH) The present writ petition has been filed praying for the following reliefs: "a. set aside the impugned order dated 29.01.2026 passed by the Hon'ble State Consumer Disputes Redressal Commission in EA No.46/2021 (Annexure-A) by issuing writ of certiorari or any order in nature of writ; b. to grant such other relief or reliefs as this Hon'ble Court may deem fit in the interest of justice and equity." - 3 - HC-KAR NC: 2026:KHC:17831-DB WP No. 8473 of 2026 2. The petitioner who is a builder has suffered the order of the Karnataka State Consumer Disputes Redressal Commission dated 01.02.2021 in C.C.No.159/2016. The State Commission has directed the petitioner to refund the amount of Rs.28,25,000/- along with interest at 12% per annum from the date of the receipt till realization and to pay Rs.50,000/- towards litigation charges with a period of thirty (30) days from the date of receipt of the order to the respondent. 3. The petitioner has preferred an appeal before the National Consumer Disputes Redressal Commission against the said order passed by the State Commission in First Appeal No.259/2021. 4. The learned counsel for the petitioner submits that the National Commission has not granted an interim order till date and has not disposed of the appeal and in the meantime the petitioner is facing execution proceedings. 5. It appears that the petitioner has not made the statutory deposit to maintain the appeal yet he seeks an interim order to stay the execution proceedings. - 4 - HC-KAR NC: 2026:KHC:17831-DB WP No. 8473 of 2026 6.
