This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.421/2025 registered at Police Station Shivrinarayan, District- Janjgir Champa (C.G.) for the offence punishable under Sections 20 (b), 2 (A) (as per impugned order) of N.D.P.S Act. Case of the prosecution, in brief, is that on the basis of a secret information received on 24.09.2025, the police intercepted a Bolero vehicle and a motorcycle near Shivrinarayan. During the search of the Bolero, 55.320 kg of Ganja was recovered. The occupants disclosed that the contraband had been arranged by co-accused Vikas Kalet for delivery to Bilaspur. During investigation, Vikas Kalet disclosed that he had been procuring Ganja from Odisha and, on further interrogation, named the present applicant as the supplier of the seized contraband. Accordingly, the applicant was implicated for the offence punishable under Sections 20 (b), 2 (A) of N.D.P.S Act. and after investigation, the charge-sheet was filed before the competent Court. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. It is argued that no contraband was recovered from the possession of the applicant and he was neither present at the place of seizure nor in conscious possession of the seized Ganja. It is further submitted that the applicant has been implicated only on the basis of the memorandum statement of the co-accused. Learned counsel further submits that the investigation is complete, the charge-sheet has been filed, and the applicant has been in custody since 11.10.2025, applicant has no criminal antecedents and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case. She would submit that name of the applicant has come into light in the memorandum statement of co-accused from whom contraband article 3 Ganja i.e. 55.320 kg was recovered which is above the commercial quantity and allegation against the applicant is that he is the supplier of the seized contraband. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, nature of allegation against the applicant, further the fact that name of the applicant has come into light in the memorandum statement of co- accused from whom contraband article Ganja i.e. 55.320 kg was recovered which is above the commercial quantity and allegation against the applicant is that he is the supplier of the seized contraband, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Vikas Kalet involved in Crime No.421/2025 registered at Police Station Shivrinarayan, District- Janjgir Champa (C.G.) for the offence punishable under Sections 20 (b), 2 (A) of N.D.P.S Act, is rejected. 8.
