HC-KAR NC: 2026:KHC:31451 WP No. 15643 of 2026
THIS W.P. IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA TO 1. DIRECT THAT THE CROSS- EXAMINATION OF PW-1 BE TREATED AS CONCLUDED, AND DIRECT THE LEARNED TRIAL COURT TO PROCEED WITH CRL.
MISC. NO. 154/2018 FROM THE STAGE OF RESPONDENT’S EVIDENCE, CONCLUDING THE PROCEEDINGS IN THEIR ENTIRETY WITHIN 60 DAYS FROM THE DATE OF THIS ORDER. (ANNEXURE A1 COLLY – SCHEDULE A, SCHEDULE C, SCHEDULE D) AND ETC.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA
ORAL ORDER
Heard Ms.Sowmya Subramanian, party-in-person and have perused the material l on record.
2. The petitioner appears in person, seeks a spate of prayers. The petitioner in person would however restrict the submission to a direction to the concerned Court for expeditious disposal of the proceeding, as the petitioner submits that about 35 hearings have taken place and there is no progress in the case and the respondent does not appear before the Court at all. Therefore, the complainant stands at the doors of this Court.

3. The perusal at the pleading or the order sheet appended to the petition would depict an appalling situation of the proceedings pending for the last eight years without any progress. Therefore, if the respondent is not appearing before the Court, the Court ought to have unleashed the coercive arm of law directing appearance of the complainant, while that is not done, but the adjournments are granted for its asking is what the order sheet would depict.
4. In that light, I deem it appropriate to infuse finality into the proceedings by directing the concerned Court to conclude the proceedings within an outer limit of four months from the date of receipt of the copy of the order, if not earlier.
5. It is needless to observe that the petitioner and the respondent to the case would cooperate for closure of the proceedings. In the event they would not cooperate, the concerned Court is at liberty to pass necessary orders in accordance with law. The concerned Court shall answer all the
contentions of the petitioner.
