The petitioner is apprehending his arrest in connection with Pakur Malpahari PS Case No.320 of 2025, for offence registered under section 303(2) and 317(2) of BNS, 2023, sections 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rule 54 of Jharkhand Mines and Minerals Concession Rules and Rules 7,9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, pending in court of learned S.D.J.M, Pakur. 3. Learned counsel for the petitioner submits that the petitioner happened to be the owner cum driver of the tractor and the allegations are made of carrying 150 cft stone chips on the said tractor. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.6 of the petition. He also submits that in the seizure list, there is no independent witness and the seizure list has been prepared in the police station. 2026:JHHC:2570 2 4. Learned State counsel opposes prayer and submits that the allegations are there of illegally carrying 150 cft stone chips on said tractor. 5. Looking to the contents of the seizure list, it transpires that it has been prepared in the police station and the petitioner happened to be owner cum driver of the said tractor and in that view of the matter, the petitioner above named is directed to surrender before learned court within two weeks from today and learned court shall release petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
