This writ petition has been filed seeking a direction to the respondent authorities, particularly the Land Acquisition Officer, Dabhra, District Sakti, to consider and decide the petitioner's objection/representation (Annexure P/2) regarding the nature of the acquired land and the calculation of compensation before YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2026.07.01 18:13:29 +0530 2 passing the final award in the land acquisition proceedings initiated on account of the submergence of the petitioner's land for the construction of Ghatoi Dam. 2. Learned counsel for the petitioner submits that the petitioner is the owner of land bearing Khasra No. 27, admeasuring 0.024 acre, situated at Village Kabaripali, Tahsil Dabhra, District Sakti (C.G.). It is submitted that the said land is likely to be submerged due to the construction of Ghatoi Dam and land acquisition proceedings are presently pending before the Land Acquisition Officer, Dabhra. Learned counsel further submits that while determining the compensation payable to the petitioner, the competent authority has failed to assess the correct nature and valuation of the land in accordance with the applicable guidelines. According to him, the petitioner's land is situated abutting the road, however, the appropriate rate applicable to roadside land has not been taken into consideration, resulting in an erroneous calculation of compensation. It is further submitted that the petitioner has already preferred an objection/representation (Annexure P/2) before the competent authority raising all such grievances, but the same is still pending consideration and the respondents are likely to pass the final award without deciding the said objection. He, therefore, submits that a direction to the competent authority to consider and decide the petitioner's objection before passing the final award would sufficiently redress the grievance raised in the present petition. 3 3. Considering the limited prayer made by learned counsel for the petitioner and without expressing any opinion on the merits of the claim, the concerned Land Acquisition Officer, Dabhra, District Sakti (C.G.) is directed to consider and decide the petitioner's objection/representation (Annexure P/2), strictly in accordance with law, after affording an opportunity of hearing to the petitioner, within a period of 60 days from the date of receipt of a certified copy of this order or before passing the final award in the land acquisition proceedings, whichever is earlier. 4.
