No. 24314 of 2023 and I.A.s, and pass Counsel for the Petitioner: 1. PEDDI VIJAYBHASKAR Counsel for the Respondent(S): 3 1. GP FOR FINANCE PLANNING 2. GP FOR SOCIAL WELFARE The Court made the following: 4 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.24314 of 2023 ORDER: 1. The present Writ Petition is filed questioning the action of the Respondent Nos.1 to 5 in not releasing the sanctioned amount Rs.10,00,000/- (Rupees Ten Lakhs only) for financial assistance of Petitioner No.2 under the Scheme of 8Videshi Vidya Dharana9 Overseas Scholarship vide Application ID No.OV2018119981, as illegal and arbitrary. 2. The facts leading to filing of the writ petition are as follows: The Petitioner No.2 was selected for an overseas scholarship under the 8Videshi Vidya Dharana9 scheme (Application ID No. OV2018119981) to pursue Master of Science (Computer Networks and Systems Security) in University of Hertfordshire, United Kingdom (U.K.). Although the initial application was for Computer Networking Course in Montreal College, Canada, the Petitioner No.2 subsequently secured admission at University of Hertfordshire, United Kingdom (U.K.), which was duly updated in the e-pass website. The Petitioner No.2 successfully completed his Master of Science (Computer Networks and Systems Security) in University of Hertfordshire, United Kingdom (U.K.). 5 3. Despite receiving a confirmation mail regarding the selection and sanction of Rs.10,00,000/- (Rupees Ten Lakhs only) under the scheme, and an onsite vigilance enquiry being completed, the Respondents have not released the funds. Hence, the present Writ Petition is filed. 4. Learned Assistant Government Pleader for Social Welfare on instructions submits that the Petitioner No.2 is not entitled for financial assistance as he has changed the University without prior permission from the SLSC. 5. Heard Sri Peddi Vijay Bhaskar, learned counsel for the Petitioner Nos.1 and 2 and learned Assistant Government Pleader for Social Welfare. 6. There is no dispute that the Petitioner No.2 has completed Master of Science (Computer Networks and Systems Security) in University of Hertfordshire, United Kingdom (U.K.) and the fact that financial assistance was sanctioned for the study in another University would not be relevant as long as there is no dispute that the Petitioner No.2 has completed Master9s Degree. Trivial technicalities should come in the way for implementation of welfare measures. 7. Therefore, this Writ Petition is disposed of, with the following directions:- 6 (i) The Respondents are directed to examine the claim of the Petitioner No.2 for reimbursement of fees under Videshi Vidya Dharana Scheme without reference to the change of the College/University within a period of three (03) months from the date of receipt of a copy of this order and pass appropriate orders. (ii) There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ________________________ JUSTICE NYAPATHY VIJAY Date: 11.03.2026 chs 7 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY 156 WRIT PETITION No.24314 of 2023 Dated:11.03.2026 chs
