Accused no.1 in Crime No.53/2026 registered by CCB Bengaluru City Police, Bengaluru City, for the offences punishable under Sections 318(4), 352, 351(2), 351(3), 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.53/2026 was registered by CCB Bengaluru City Police, Bengaluru City, for the aforesaid offences against the petitioner and her brother Charan based on the first information dated 30.04.2026 received from Pushpa W/o Gopi. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.4537/2026 before the jurisdictional Sessions Court, - 3 - HC-KAR NC: 2026:KHC:31955 CRL.P No. 7497 of 2026 which was rejected on 29.05.2026. Therefore, she is before this Court. 4. Perusal of the typed first information dated 30.04.2026 submitted by the first informant would reveal that she is working as a Peon in the Computer Centre at Vidhana Soudha. She has stated that for the last 15 years she is acquainted with the petitioner herein, who allegedly represented to her that she would provide Group-D jobs to her relatives and had demanded money. She has further stated that she had collected money from aspiring candidates and had paid a total sum of Rs.24 lakhs to the petitioner. She has also stated that petitioner who had promised to secure jobs to the aspirants had not fulfilled her promise, and therefore, after she demanded repayment, petitioner allegedly had repaid a sum of Rs.10 lakhs. She has stated that on 31.01.2026, she had gone near the house of the petitioner demanding repayment, her brother accused no.2 allegedly abused her and also criminally intimidated her. First information is therefore belatedly filed on 30.04.2026. 5. Undisputedly, first informant is not the victim in the present case. Accused no.2 who was arrested in the present - 4 - HC-KAR NC: 2026:KHC:31955 CRL.P No. 7497 of 2026 case has been released by the Court of jurisdictional Magistrate. Petitioner is a lady aged about 41 years. She has undertaken to co-operate with the police for the purpose of investigation. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the said alleged offences is imprisonment for a period of seven years. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 6. The criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.53/2026 registered by CCB Bengaluru City Police, Bengaluru City, for the offences punishable under Sections 318(4), 352, 351(2), 351(3), 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- - 5 - HC-KAR NC: 2026:KHC:31955 CRL.P No. 7497 of 2026 with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and she shall co-operate with the police for investigation and appear before them whenever called upon. 4.
