JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question proceedings in C.C.No.17089/2020, pending before the 8th Additional Chief Judicial Magistrate, Bengaluru, - 3 - HC-KAR NC: 2026:KHC:29840 CRL.P No. 4990 of 2026 for the offences under Sections 341, 324, 504, 506 r/w. 34 of the IPC. 2. Learned counsel for the petitioners and respondent No.2 in unison would submit that during the subsistence of these proceedings, the parties to the lis, who are husband and wife and their son, have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application under Sections 359(2) r/w. 528 of the BNSS, 2023 along with a joint affidavit before this Court seeking permission to compound the offences. 3. The joint affidavit reads as follows: “1. XXXX 2. XXXX 3. We state that in View of the close relationship the Respondent No. 2/De-Facto do hereby withdraws all the allegations made by him against petitioners No. 1 & 2 which is the subject matter in C.C. No. 17089/2020, pending Impugned in this petition on the file of HON'BLE VIII ADDL CHIEF JUDICIAL MAGISTRATE, BENGALURU CITY have agreed and Jointly prayed that this Hon'ble Court pleased to permit us to compound this case. 4. The petitioner No.1 agreed to withdraw the case filed against the Respondent No.2 in Crime No. 209/2019, and in CC No. 17608/2020, Hebbal police station pending on the file of HON'BLE VIII ADDL CHIEF JUDICIAL MAGISTRATE, BENGALURU CITY for the offenses punishable under sections 324, 504, 506 R/w 34 of IPC. - 4 - HC-KAR NC: 2026:KHC:29840 CRL.P No. 4990 of 2026 5. It is further agreed among us & I Sabajaan/2nd respondent will withdraw the O.S.No. 458/2023, pending file of the Hon'ble 5th Additional Judge Family Court At Bangalore, filed against the Petitioner No.1/wife, seeking the decree of Divorce on the next date of hearing before the Said court I.e., on 17/07/2026. 6. It is further agreed among us that, 2nd Respondent will get annulled the Orders passed by the Assistant Commissioner Bangalore in Case No.MSC/CR/156/2023, under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act 2007 & disputes related to the property and maintenance amount with petitioners which is subject matter in W.P. No. 35981/2024, and W.P.No. 35730/2024, pending file before this Hon'ble Court. 7. The Parties have entered into this Joint Affidavit on their own volition without any influence or coercion and after understanding the contents of the Joint Affidavit. Wherefore, the petitioner and respondent no. 2 herein respectfully pray that this Hon'ble Court may kindly be pleased to quash the Further Proceedings in C.C. No. 17089/2020, pending on the file of HON'BLE VIII ADDL CHIEF JUDICIAL MAGISTRATE, BENGALURU CITY for the offenses punishable under sections 341, 324, 504, 506 R/w 34 of IPC in the interest of justice and equity.” In the light of the afore-quoted joint affidavit of the parties, I deem it appropriate to terminate the proceedings against the petitioners, as it is a matrimonial dispute and the allegations are not against the State. 4.
