Heard learned counsel for the parties.

The instant writ application has been preferred by the petitioner for the following reliefs:
“1. That the instant writ application petitioner prays for issuance of an appropriate writ(s) / order (s) / direction (s) commanding upon the respondents to grant the promotion to the petitioner w.e.f. 31.01.2011 to the post of Clerical Grade-III under the respondents but the petitioner still working as Time Rated when the petitioner is entitled for monthly rated i.e. Clerical Post and / or pass such further order /orders as your Lordship may deem fit and proper in the facts and circumstances of the case and in the interest of justice.”

Learned counsel for the petitioner submits that since 2008

the respondents have initiated a proceeding for promotion but till date they have not finalized the matter when the petitioner is having requisite qualification of the post of Clerical Grade-III. He submits that this writ application may be disposed of with liberty to the petitioner to approach the concerned respondent for redressal of his grievance.

Learned counsel for the respondents submits that since no counter affidavit has been filed, as such the petitioner may approach the concerned respondent for redressal of his grievance.

Having regard to the aforesaid, the instant writ application is hereby disposed of by directing the petitioner to approach the 3rd Respondent by filing a detailed representation along with all relevant documents. The moment the 3rd Respondent receives such representation, he shall look into the matter and after verification of the record, send the matter to respondent no. 2 who shall take a decision in the matter with regard to the claim raised in the writ application in accordance with law and applicable rules and regulations by passing a reasoned and speaking
order. The entire exercise shall be completed within a period of 8 weeks from the date of receipt/production of copy of this order.

It goes without saying that if the decision is taken in favour of the petitioner, necessary consequential order be issued within a further period of 4 weeks.
