The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.276/2025, registered at Police Station - Gandhinagar District- Surguja (C.G.) for the offences punishable under Sections 22(C), 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act. 2. As per the prosecution case, on 07.05.2025 at about 6:50 PM, the police authorities conducted a search of the rented house of co-accused Sonu Yadav, situated at Village Gangapur within the jurisdiction of Police Station Gandhinagar. During the course of the search, the police PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.07.01 14:40:56 +0530 2 recovered 450 injections of Avil Pheniramine Maleate Injection IP 10 ml (total quantity 4,500 ml) and 800 injections of Rexogesic Buprenorphine Injection IP 2 ml (total quantity 1,600 ml) from the possession of the present applicant/accused. Since the recovered substances were alleged to be psychotropic substances, a case was registered against the applicant and the other accused persons for offences punishable under Sections 22(C), 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Pursuant thereto, the applicant was arrested on 08.05.2025 at about 1:30 PM in connection with Crime No. 276/2025 registered at Police Station Gandhinagar, and since then he has been facing prosecution for the aforesaid offences. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that no contraband or any prohibited narcotic drug or psychotropic substance was recovered from the house or conscious possession of the applicant during the search conducted by the police. It is also submitted that the applicant has no criminal antecedents. The applicant has been in judicial custody since 08.05.2025. As the conclusion of the trial is likely to take considerable time, it is prayed that the applicant be enlarged on bail. 4. On the other hand, the learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that the quantity of narcotic substance which has been seized from the possession of the present applicant, is much above the commercial quantity and the applicant 3 has failed to give any explanation for the same and it cannot be said to be a case of false implication, hence, this Court is of the opinion that it is not a fit case to release the applicant on bail. 7. Accordingly, the bail application of applicant – Pankaj Gupta, involved in Crime No.276/2025, registered at Police Station - Gandhinagar District- Surguja (C.G.) for the offences punishable under Sections 22(C), 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
