The present writ petition has been filed under Article 226/227 of the Constitution of India averring therein that the petitioner has filed an appeal which is pending before respondent No.1 - Secretary-cum-Joint Development Commissioner (exercising the powers of Commissioner), Department of Rural Development and Panchayat, Punjab - alongwith an application for stay.

Learned counsel for the petitioner has stated that though the appeal was filed alongwith the application for stay as far back as 01.09.2025, however, no orders have been passed on the application for stay despite the appeal being a statutory appeal. Learned counsel further states that he limits his prayer in the present petition and that the petitioner would be satisfied if a direction is given to respondent No.1 to decide the stay application in a time- bound manner and till such time as the application for stay is decided, no coercive action be taken.

Mr. Aman Dhir, DAG Punjab accepts notice on behalf of respondent Nos.1 and 2/State and he is not in a position to deny that the stay application has not been dealt with by respondent No.1 till date despite the appeal having been filed as far back as 01.09.2025.

In view of the above, the present petition is disposed off with a direction to respondent No.1, Secretary-cum-Joint Development Commissioner (exercising the powers of Commissioner), Department of Rural Development and Panchayat, Punjab, to decide the stay application expeditiously and in accordance with law and till such time as the application for stay is decided, no coercive action would be taken against the petitioner.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
