After arguing for a while, learned counsel for the petitioners, when confronted with the maintainability of the instant petition, with regard to serious allegations leveled in the impugned FIR, which culminated into the filing of the challan before the competent Court. Accordingly, seeks withdrawal of the instant petition with liberty to approach the competent Court where the challan has been filed. 2. The writ petition, in the aforesaid backdrop and keeping in view the statement made by learned counsel for the petitioners, is dismissed as withdrawn with liberty to the petitioners to approach the learned trial Court where the challan has been filed and where the petitioners will be permitted to raise all legal and factual grounds available before the said Court. 3. However, no opinion on the merits of the case has been expressed in the instant matter while dismissing the instant matter and learned trial Court shall proceed in accordance with Serial No. 176 2 CRM(M) No. 907/2026 law without being influenced by any observation made by this Court while dismissing the instant petition.
