The Court :- The petitioner has preferred the present application under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award. Learned Counsel for the petitioner submits that this Court vide order dated 12th March, 2023 had appointed the learned sole arbitrator to adjudicate the disputes between the parties. The pleadings were completed on 18th October, 2023. This Court on three earlier occasions vide order dated 29th April, 2025, 22nd September, 2025 and 31st March, 2026 had extended the mandate of the arbitral tribunal by periods of six months, six months and two months respectively for publication of the award. 2 As the arguments completed on 17th November, 2024. Despite three extensions, the award has still not been passed and the present petition has been preferred. Learned counsel for the parties’ submit that they do not seek substitution of the learned sole Arbitrator at this stage, keeping in mind the fact that the arguments were concluded on 17th November, 2024 and that the arbitral award has not yet been published. It is jointly requested that the learned Sole Arbitrator shall make all reasonable endeavours to publish the arbitral award within a period of three months from today. The parties shall be at liberty to file appropriate applications in accordance with law in the event the arbitral award is still not published within the extended time period of three months from today.
