Mr. Rudra Narayan Parija, learned counsel for the petitioners by filing a memo prays to not press the bail application of petitioner No.2- Hilarus @ Hilarush Lakra and accordingly, the prayer for bail to the petitioner No.2- Hilarus @ Hilarush Lakra stands disposed of as not pressed and the present bail application is only confined to petitioner No.1- Simon Lakra. 3. This is an application U/S.483 of BNSS by the petitioner No.1 for grant of bail in connection with Rajgangpur P.S. Case No. 53 of 2022 corresponding to ST Case No. 125 of 2022 pending in the file of learned District & Sessions Judge, Sundargarh, for commission of offences punishable U/S. 302/201/34 of IPC, on the allegation of committing murder of one Fuljames by assaulting him with sharp cutting weapon, along with co-accused person. 4. Heard, Mr. Rudra Narayan Parija, learned counsel for the petitioner No.1 and Mr. C. Mohanty, learned Addl. Public Prosecutor in the matter and perused the record. 5. Admittedly the petitioner is in custody since 05.02.2022, but in the meantime near about four & half years have already elapsed, however, the trial is yet to be concluded. Besides, the petitioner is aged about 67years. In view of the aforesaid facts and taking into account the materials so placed on record and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and trial having not yet concluded even after near about four and half years of the custody, this Court without expressing any view on merits, admits the petitioner No.1- Simon Lakra to bail. 6. Hence, the bail application of the petitioner No.1- Simon Lakra stands allowed and he is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deems fit and proper by it with following condition:- (i) the petitioner no.1-Simon Lakra shall cooperate the further trial. 7. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference. (G.
