The petitioner is apprehending his arrest in connection with Gumla (Mahila) PS Case No.8 of 2026, for offence registered under section 69, 318(2), 351(2), 352, 3(5) of BNS, 2023, pending in court of learned Sub Divisional Judicial Magistrate, Gumla. 3. Learned counsel for petitioner submits that the petitioner has falsely been implicated in this case and what has happened that was consensual in nature and the victim is aged about 32 years and in the FIR itself it is stated that they were in relationship since last eight years. He next submits that the informant has also demanded money which has not been done and prior to that, the information petition was filed by the petitioner before the Chief Judicial Magistrate, Giridih as contained in Annexure-3 and on these grounds, he submits that anticipatory bail may kindly be granted. 2026:JHHC:25722 2 4. Learned State counsel opposes prayer and submits that allegations are there of establishing relationship on the pretext of marriage. 5. On perusal of the FIR, it transpires that said relationship was there since last eight years as alleged in the FIR and the FIR was lodged on 30.04.2006 and in the FIR it has also been stated that they have voluntarily met on different places and one Senha was also filed by the petitioner as contained in Annexure-3 and thereafter the FIR was lodged on 30.04.2026, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sub Divisional Judicial Magistrate, Gumla, in connection with Gumla (Mahila) PS Case No.8 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
