JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this Court seeking for the following reliefs: "i. To quash the impugned letter/order dated 11.11.2024 bearing No.CO 54 CSR 2023 passed by respondent No.1 as found at Annexure-M; ii. To issue writ in the writ in nature of mandamus appoint the Administrator to the petitioner society by considering the letter dated 13.06.2024 bearing No.rDgïr:¸ÀA.£ÉÆA:J¸ïNDgï. 67/79-80/2024-25 issued by respondent No.2 to the respondent No.1 as Annexure-L; & iii. To allow this writ petition and issue any other appropriate writ or direction or pass any other orders as this Hon'ble court deems fit to pass in the circumstances of the case, in the interest of justice and equity.” 2. Petitioner in the present matter is a society represented by a member and the relief which has been sought for is for implementation of the order - 4 - HC-KAR NC: 2026:KHC:31606 WP No. 8415 of 2025 dated 13.06.2024 at Annexure-L and for quashing of the order dated 11.11.2024 by which the documentation submitted by respondent No.3 was accepted. 3. The contention of Sri R. Bhadrinath, learned counsel for the petitioner, is that from last eight years there has been no elections which have been held to the society and it is for that reason that a representation had been submitted for appointment of an administrator, which has been considered favourably vide Annexure-L dated 13.06.2024. 4. Despite this, the documents of appointment submitted by respondent No.3 has been accepted on 11.11.2024. 5. The petitioner had earlier approached this Court in WP No.39380/2022 and a Co-ordinate Bench of this Court, vide its order dated 04.07.2022 had observed that as regards any dispute interse between members, it would always be available for the - 5 - HC-KAR NC: 2026:KHC:31606 WP No. 8415 of 2025 members to approach the appropriate authority or Civil Court with regard to the grievance relating to the constitutional management of the society etc. The said order still holds force, despite which the present petition has been filed more or less for similar reliefs. 6. This petition is also not maintainable for the very same reason in as much as a society and the membership thereof being a creatures of contract between the members. Any dispute between members can only be agitated before a Court of competent jurisdiction. 7. The official respondents cannot be involved in the personal disputes of the members which have no bearing on the operation of the Societies Registration Act, 1960. 8. In that view of the matter, the above petition is dismissed, reserving liberty to the petitioner to approach the appropriate Civil Court. - 6 - HC-KAR NC: 2026:KHC:31606 WP No. 8415 of 2025 9.
