CORAM:
THE HON'BLE MR. JUSTICE BIRAJA PRASANNA SATAPATHY
ORDER 03.07.2026
Order No. 01
1. This matter is taken up through hybrid mode.
2. Heard learned counsel appearing for the Parties.
3. The present Writ Petition has been filed inter alia challenging the
order of transfer issued by Opp. Party No.2. vide order dated 12.06.2026 under Annexure-1. Vide the said order Petitioner has been transferred from Denua SC under CHC, CHarichhak to Pidhapatana SC under CHC, Delang.
3.1. It is contended that since Petitioner has recently suffered a leg injury and in the meantime her daughter has already taken admission in a school at Nimapada, transfer of the Petitioner to Delang will cause prejudice to her.
3.2. It is also contended that Petitioner’s husband since serving in a private company, which is around 200 KMs from the present place of posting of the Petitioner, Petitioner in order to take care of her two (2) minor children will face immense difficulty, if the order of transfer is not interfered with.

3.3. Even though Petitioner has moved an application seeking cancellation of the order of transfer under Annexure-5, but till date, no action has been taken.
3.4. It is however fairly contended that Petitioner since was relieved in the meantime vide order dated 25.06.2026 under Annexure-4, Petitioner is continuing on leave.
4. Learned Addl. Govt. Advocate on the other hand contended that since Petitioner has not approached the competent authority seeking cancellation/modification of the order of transfer, the Writ Petition is not maintainable.
5. Having heard learned counsel for the Parties and considering the submission made, this Court while disposing of the Writ Petition permits the Petitioner to make a fresh application by 10th July, 2026 before Opp. Party No.2, for cancellation/modification of the order of transfer issued on 12.06.2026.
6. It is observed that if any such application is moved by 10th July, 2026, Opp. Party No. 2 shall do well to take a lawful decision on the same by 31st July, 2026. The order so passed by Opp. Party No. 2 be communicated to the Petitioner.
7. Till 31st July, 2026, no coercive action be taken against the Petitioner.
