The Court:- The petitioner has preferred the present petition under Section 14 of the Arbitration and Conciliation Act, 1996 seeking termination of the mandate of the learned sole arbitrator and appointment of a fresh arbitrator. At the outset itself, learned counsel for the respondent states that he has no objection to the present application and that the same can be allowed. Accordingly, the mandate of the earlier learned sole arbitrator stands terminated. With the consent of the parties, Mr. Debraj Sahu Bar Library Club, 2nd Floor, High Court at Calcutta (Mob- 9831544867) is appointed as a learned sole arbitrator to adjudicate the disputes between the parties. 2 The learned sole arbitrator shall comply with the provisions of Section 12 of the Act before entering upon the reference. The discloser in terms of Section 12 shall be made by the learned sole arbitrator. The learned sole arbitrator shall be at liberty to determine his remuneration in accordance with the Forth Schedule of the Arbitration and Conciliation Act, 1996, and shall conduct the arbitral proceedings in accordance with law. The parties are directed to forthwith communicate a copy of this order to the learned sole arbitrator. All questions relating to arbitrbility of the dispute, admissibility of the claims, limitation and other issues are kept open to be urged before this learned Sole Arbitrator. With the aforesaid directions, the present petition stands disposed of. (GAURANG KANTH, J.) R. D. Barua
