02/ 24.08.2026: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Telaiya P.S. Case No.152 of 2026, for the alleged offences registered under Sections 272, 274, 275, 292 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a)(f) of Excise Act pending in the Court of learned A.C.J.M., Koderma. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and they have been implicated only on the basis of secret information. He further submits that name of the person, who has taken the name of the petitioner, is not disclosed in the FIR. He then submits that jawa mahuwa and other materials have been recovered from forest area and that is not belonging to the petitioners. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition. He next submits that co-accused persons have been granted anticipatory bail in A.B.A. No. 4716 of 2026. He also submits that the petitioners will cooperate in the investigation. On these grounds, he submits that anticipatory bail may kindly be granted. ( 2026:JHHC:25502 )
4. Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioners has come on suspicion. 5. Considering that the name of the petitioners has come only on suspicion and the name of the person, who has taken the name of the petitioners, is not disclosed in the FIR and even the place of occurrence is forest area and that is not of the petitioners and the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition and co- accused persons have been granted anticipatory bail in the aforesaid A.B.A, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Koderma in connection with Telaiya P.S. Case No.152 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. Dt.24. 08.2026
