This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, the B.N.S.S.) for grant of regular bail to the applicants who have been arrested in connection with Crime No. 357/2025 registered at Police Station – Pandri, Raipur (C.G.), for the offence punishable under Sections 103, 190, 191, 238, 351(2) of Bhartiya Nyay Samhita, 2023 (for short, the Digitally signed by ALLENA ANJANI KUMAR Date: 2026.07.01 17:00:57 +0530 2 BNS). 3. As per the prosecution’s case, on 18.12.2025, during the procession of Guru Ghasidas Jayanti, Dinesh Nishad was dancing along with his friends and during course of such dancing, some altercation took place, in which, the applicants/accused party assaulted him with steel pipes, a steel bangle, hands and fists and also with knife and stabbed him twice on his chest and major parts of his body, as a result of which, Dinesh Nishad succumbed to the injuries. Father of the deceased lodged an oral complaint at Police Station, Pandri. Based on this, offence under the aforesaid sections has been registered against the present applicants. 4. Learned counsel for the applicants submits that the applicants are innocent and have not committed any offence and they were falsely implicated in this case. He further submits that the alleged incident took place on the occasion of Guru Ghasidas Jayanti and in such procession the deceased was dancing closely with some women and when he was forbidden from doing so, the alleged dispute arose leading to the unfortunate incident. He also submits that the applicants are in jail since 20.12.2025 and that, trial is going on and it may take some considerable time to conclude. On these premises, he prays for the grant of regular bail to the applicants. 5. On the other hand, learned counsel for the State opposes the bail application, while submitting that the applicants along with other co- accused persons assaulted the deceased with steel pipes, a steel bangle, hands and fists and also with knife on his chest and major parts of his body, and named F.I.R. was lodged against them therefore, the applicants do not deserve regular bail. 3 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of the offence and taking into account that the trial is going on, I am not inclined to release the applicants on bail. 8. Accordingly, the application filed under Section 483 of B.N.S.S. is rejected at the admission stage. 9.
