ORAL ORDER
The petitioner is before this Court calling in question the proceedings in C.C.No.22459/2025 registered for offences punishable under Sections 85, 352, 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023. - 3 -

2. Heard Sri. Ronald Desa, learned counsel appearing for the petitioner, Smt. Rashmi Patel, learned High Court Government Pleader appearing for respondent No.1, Smt. Misbah Shan, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the compromise affidavit. Terms of settlement reads as follows:
"COMPROMISE AFFIDAVIT
We, 1), I, Syed Hamid Farhan, C/o Faiz Unnisa, aged about 45 years, R/at No.90, 4th Ground Floor, Kousar Nagar Dinnur, R.T.Nagar, Bangalore-32, the Petitioner in this petition 2) I, Fathimunissa, W/o Syed Hamid Farhan, aged about 35 years, currently R/at No. 107, Vasanthappa Block, Kulsum Salon, 4th Floor, 10th Cross, CBI Main Road, Bangalore-32, the. The 2nd Respondent/ first informant in this petition do hereby jointly and severally state and solemnly affirm as under on oath:
1. We, state that our marriage was solemnized on 27.11.2011 as per Islamic rites and customs at Safina Garden. One son named Syed Ahad Yaseen is born out of the wedlock who is currently 13 Years old. 2. We, state that certain differences and misunderstandings had arisen between us, leading the Respondent no 2 to lodge a complaint against

the Petitioner before the North women Police station which is registered as Crime No 32/2025 for the offences under section 85,352,351(2) of BNS, which has been culminated to the filing of the chargesheet which is numbered as CC No.22459/2025 currently pending before 32nd ADDL CMM COURT, Nrupatunga Road, Bangalore City for the offences punishable under section 85,352,351(2) of BNS. 3. We state that Respondent No 2 has filed one more complaint against the petitioner which is numbered as Crl. Misc No 83/2025 seeking various reliefs under Domestic Violence Act which is now pending before the Judicial Magistrate First Class (Traffic Court-VI), Bengaluru City. 4.
We, state that after the registration of the above criminal cases, we have amicably and voluntarily settled all our disputes in full and final settlement at the intervention of the elders of both the family members and mutual discussions. This settlement is Bonafide, entered into by us out of our own free will, without coercion, undue influence, fraud or misrepresentation whatsoever. 5. That the terms of the full and final settlement arrived at between us are as follows:
a. The Petitioner undertakes to pay the Respondent No. 2, a sum of Rs. 5,00,000/- (Rupees Five Lakhs only) to towards the full and final settlement of all her claims (past, present and future maintenance, etc.) before this Hon'ble Court, when the instant petition comes for disposal before this Hon'ble Court. b. The said amount will be paid by the Petitioner to the Respondent No. 2 by way of handing over the Demand Draft No. 076358 dated 29.04.2026 drawn on Indus Ind Bank, R.T. NAGAR Branch before this Hon'ble court. - 5 -

c. Subject to the payment of the said settlement amount, the Respondent No 2 has no objections towards C.C No. 22459/2025 that is currently pending before 32nd Addl Chief Judicial Magistrate Court, Bangalore City against the Petitioner in being quashed by the Hon'ble High Court of Karnataka. d. The Respondent No. 2 further undertakes to withdraw her petition filed under Section 12 of the Protection of Women Against Domestic Violence Act, 2005 against the petitioner which is numbered as Crl. Misc. No. 83/2025, mending before the Judicial Magistrate First Class (Traffic Court - VI), Bengaluru City. e. The custody of the minor son, namely Syed Ahad Yaseen, born out of the wedlock of the Petitioner and Respondent No. 2, shall vest with the Petitioner, who shall bear all responsibilities towards his education, daily needs, and any other necessary expenses.
f. That the Petitioner will not come in between the relationship of Respondent No. 2 and their son and the Respondent No. 2 will have the right to meet her son thrice a week as and when it is convenient to all the parties. g. The Petitioner and Respondent no 2 have also mutually agreed to dissolve their marriage by executing a Deed of Mubarrat (mutual divorce under Muslim Personal Law) on the day the impugned proceedings would be reported to be quashed before the Hon'ble 32nd ACMM, Bengaluru and the Respondent No.2 withdraws her petition bearing Crl. Misc. No. 83/2025 before the Judicial Magistrate First Class (Traffic Court- VI), Bengaluru City. - 6 -

h. The Petitioner and Respondent No 2 hereby declare that their marriage would stand dissolved upon the execution of deed of Mubarrat with immediate effect and they have no further claims of any nature whatsoever against each other in any court, forum or authority. 6. We, state that this compromise has been arrived at in the interest of peace and to restore amicable relations. No pressure, threat or inducement has been exerted upon either of us. We both confirm that the settlement is voluntary and in the best interest of both parties. 7. We, state that we have no other pending proceedings between us except the criminal cases stipulated above, which we pray may be quashed in view of the complete settlement. Wherefore, we humbly pray to this Hon'ble court to accept our compromise affidavit and appreciate the prayer made in the Criminal Petition, in the interest of justice and equity."

In light of the settlement arrived at between the parties as afore-quoted and the offences not being against the State, I deem it appropriate to accept the compromise affidavit and terminate the proceedings against the petitioner in the subject petition. 5. For the aforesaid reasons, the following:
ORDER (i) Criminal Petition stands disposed.

(ii) Proceedings in C.C.No.22459/2025 pending before the 32nd Additional CMM Court, Nrupatunga Road, Bangalore City, against the petitioner stands quashed.
