Petitioner, who is apprehending arrest in Crime No.75/2026 registered by Kora Police Station, Tumkauru District, for the offences punishable under Sections 115(2), 3(5), 351(2), 76, 352 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.75/2026 was registered by Kora Police Station, Tumakuru District, for the aforesaid offences against the petitioner herein and others based on the first information dated 02.05.2026 received from Siddaraju who is one of the victim in the present case. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.702/2026 before the jurisdictional Sessions Court, which was rejected on 16.05.2026. Therefore, he is before this Court. - 3 - HC-KAR NC: 2026:KHC:32230 CRL.P No. 7284 of 2026 4. Perusal of the material on record would go to show that there is a civil dispute between the parties and the parties are already before the Civil Court in O.S.No.758/2024. The material made available to this Court would also go to show that the parties have earlier filed criminal cases against each other in the background of the civil dispute between them. 5. So far as the present case is concerned, the allegation as against the accused persons is that on 01.05.2026, petitioner and three other accused persons had abused the wife of the first informant who had gone to pick up mangoes in the property in dispute and they allegedly also tried to outrage her modesty by pulling her clothes. When the first informant tried to interfere, the accused persons allegedly assaulted him and his wife and caused injuries. 6. The material on record would go to show that the first informant and his wife have suffered only minor injuries in the incident in question. Considering the nature of allegations found in the first information and also having regard to the fact that there are multiple civil and criminal cases between the parties, - 4 - HC-KAR NC: 2026:KHC:32230 CRL.P No. 7284 of 2026 I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.75/2026 registered by Kora Police Station, Tumkauru District, for the offences punishable under Sections 115(2), 3(5), 351(2), 76, 352 of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. - 5 - HC-KAR NC: 2026:KHC:32230 CRL.P No. 7284 of 2026 4.
