This Criminal Petition is filed under section 528 of Bharatiya Nagrik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) praying this court to quash the proceedings in FIR No.20/2026 dated 16.04.2026 on the file of Bellamkonda Police Station, Palnadu District, registered for the offences punishable under Section 9(1) of A.P Gaming Act and Section 112(2) of Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’), insofar as the petitioner/Accused No.1 is concerned.
2. Heard the learned Counsel for the Petitioners and learned Additional Public Prosecutor.
3. Since the alleged offences are punishable below 7 years imprisonment, the investigation officer is directed to follow section 35(3) of the B.N.S.S. There are certain allegations, on which, this court cannot conduct mini trial at this juncture, to decide as to whether the petitioner has committed offence under section 9(1) of A.P gaming Act or under Section 112(2) of ‘the B.N.S’.
4. Therefore, the present criminal petition is disposed of requiring the petitioner to file criminal petition after filing of the charge sheet. The filing of Criminal petition at the F.I.R stage is premature one. The petitioner has to wait

till the investigation concluded and appropriate proceedings filed either by way charge sheet or final report and later file criminal petition.
5. Accordingly, the Criminal Petition is disposed of. No costs.
Consequently, pending miscellaneous petitions, if any, shall stand closed.
