Mrs. Rajni Singh Dev …for the State. 1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to consider the transfer application of the petitioner dated 22nd August, 2022 applied through offline mode and allow transfer in favour of the petitioner to the opted/preferred school and/or any school nearby his residence. 3. The petitioner contends that he joined as an Assistant Teacher in Chowdhurihat Vivekananda Vidyamandir, District Coochbehar on 17th November 2007 and his service was approved on 31st December, 2007 by the District Inspector of Schools (SE), Coochbehar. The petitioner’s wife is
2 suffering from serious gynaecological problem since 2021. On 22nd August, 2022 the petitioner made an application seeking transfer on spouse medical ground before the Head of the Institution. Subsequent thereto, the Institution provided no- objection certificate and forwarded the same to the concerned District Inspector of Schools, which in turn, forwarded to the West Bengal Central School Service Commission on 14th October,
2022. However, till date the Commission has not considered the application of the petitioner seeking transfer. The Utsashree portal has been suspended for long. Hence, this writ petition. 4. Mr. Debajit Kundu, learned Advocate for the petitioner submits that the matter may be relegated to the West Bengal Central School Service Commission, respondent no.4 to consider the application of the petitioner seeking transfer, in accordance with law. 5. Mr. Samar Rakshit, learned Advocate representing the State-respondents leaves the matter to the discretion of this Court. 6. Despite service none appears on behalf of West Bengal Central School Service Commission. 3

It appears from annexure P3 to the writ petition that the transfer application of the petitioner has been forwarded by the concerned District Inspector of Schools to the West Bengal Central School Service Commission on 14th October, 2022. Thus, admittedly, the application of the petitioner seeking transfer is pending at the end of the Commission. 8.
Accordingly, the respondent no.4, the West Bengal Central School Service Commission is directed to consider the application of the petitioner seeking transfer dated 22nd August, 2022 in accordance with law, within a period of six weeks from the date of communication of this order. 9. With the above direction, the writ petition being WPA 803 of 2026 stands disposed of. 10. Petitioner is directed to communicate this
order to the respondent no.4, the West Bengal Central School Service Commission, for necessary compliance.
11. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
12. Interim order, if any, stands vacated.
13. All connected applications, if any, stand
disposed of.

14. There shall be no order as to costs.
15. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
16. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
