The petitioner is apprehending his arrest in connection with Sidhgora P.S. Case No. 91 of 2022 (S.T. No. 655 of 2022), registered for the offence under Sections 147, 148, 149, 452, 427, 307, 324, 302, 506 and 34 of the Indian Penal Code and Sections 27, 25(1-B)(a), 26(1) and 35 of the Arms Act, pending in the court of learned Principal District and Sessions Judge, Jamshedpur. 3. Learned counsel appearing for the petitioner submits that the name of this petitioner has come only on the basis of confessional statement of co-accused Rahul Singh and the petitioner has not concerned with the co-accused persons and not involved in the crime and only due to enmity, the petitioner has been implicated in this case. He next submits that no firearm, ammunition, incriminating articles or any other material have been recovered from the conscious possession of this petitioner. He further submits that there is direct and specific allegation against co-accused Rahul Singh, Akshay Singh, Gaurav Gupta and Puran Singh of entering into the house of the informant and firing upon her son Manpreet Pal Singh. He also submits that the other co-accused persons have already been provided the privilege of [2026:JHHC:25513] -2- anticipatory bail in A.B.A. No. 10395 of 2022 and A.B.A. No. 6650 of 2025. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. has opposed the prayer and submits that the name of the petitioner has come on the confessional statement. On this ground, he submits that anticipatory bail may kindly be rejected. 5. Considering that the name of the petitioner has come on the basis of confessional statement and the allegation of entering into the house of the informant and making fire upon the son of the informant is against Rahul Singh, Akshay Singh, Gaurav Gupta and Puran Singh and further in the identical situation, other co-accused persons have already been provided the privilege of anticipatory bail in the aforementioned A.B.As. and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within four weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned Principal District and Sessions Judge, Jamshedpur, in connection with Sidhgora P.S. Case No. 91 of 2022 (S.T. No. 655 of 2022), subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
