1. Heard on I.A. No. 01/2026, application for condonation of delay in filing this MCC.
2. On due consideration and for the reasons mentioned in the above application, the I.A. No. 01/2026 is allowed. Delay of 57 days in filing this MCC is hereby condoned.
3. Learned counsel for the applicant submits that the appeal came to be dismissed for non-compliance with the peremptory order dated 21.01.2026. It is submitted that all office objections raised by the Registry had been duly removed within the stipulated time. The application for condonation of delay, along with the requisite affidavit, was duly filed and uploaded, the defects relating to paging and annexures were rectified, and a covering memo dated 28.01.2026 was filed before the Registry, thereby completing all formalities in compliance with the said order. It is, therefore, prayed that the order of dismissal be recalled and the appeal be restored to its original number.

4. I have heard learned counsel for the applicant and perused the material available on record.
5. It appears that the applicant had taken steps to remove the office objections pointed out by the Registry and had also filed the covering memo in compliance with the order dated 21.01.2026. In the facts and circumstances of the case, this Court is satisfied that sufficient cause has been shown for restoration of the appeal.
6. Accordingly, the MCC is allowed. The order whereby ARBA No. 3 of 2026 stood dismissed is recalled. ARBA No. 3 of 2026 is restored to its original number. sd/-
