2. The petitioner is a residential school. By filing this writ petition, two notices i.e. notice dated 12.8.2021 (Annexure-7), as contained in Letter Camp-01, whereby, the petitioner has been directed to produce No Objection Certificate for the Deep Borewells, which are in the premises of the petitioner and notice dated 13.8.2021 as contained in Memo No. 869(ii) issued by the Circle Officer, Namkum, whereby the petitioner has been
directed to remove the encroachment from the Plot Nos. 49, 551, 30 and 10 of Khata Nos. 45 and 85. Notice dated 19.8.2021 has also been challenged whereby the petitioner has also been directed to remain physically present for measurement of the land.

So far as No Objection Certificate in relation to borewell is concerned, I direct the petitioner to approach the Deputy Commissioner and the produce the No Objection Certificate, if any, for the numbers of deep borewells, which are in the premises of the petitioner and if the petitioner has not obtained any No Objection Certificate, the petitioner may apply for the same and if the Rules permit, the Deputy Commissioner may grant post facto sanction and if it is not possible to grant post facto sanction for the borewells, the reasons thereof should be communicated to the petitioner, so that the petitioner can take appropriate steps thereafter.
4. So far as encroachment is concerned, it is made clear that without initiating any proceeding, none of the portion of the building of the petitioner
can be demolished. If the respondents want to proceed against the petitioner on the ground of encroachment, a detailed notice should be issued to the petitioner clearly mentioning the area which the petitioner has encroached and only after conclusion of the proceeding under the Land Encroachment Act, the respondents can take appropriate steps against the petitioner.
5. With the aforesaid observations and direction, this petition stands
disposed of. Pending interlocutory applications, if any, stand disposed of.
