This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking release of the accused who has been arrested in connection with ACB Police Station Case No. 13/2025, registered under Sections 61/336/318/316(5)/319 of the Bharatiya Nyaya Sanhita, 2023, read with Sections 7/13(1)(a)(b)/2 of the Prevention of Corruption Act, 1988. Page No.# 2/3 3. Mr. Pada, learned Spl. P.P., ACB, fairly submits, on record, that the Account No. 110233657700 maintained by the accused i.e. Shri Yayo Yangfo, and the Account No. 110233645860 maintained by the wife of the accused, namely, Smt. Sita Sonam, respectively, in the Chayangtajo Branch of Canara Bank, East Kameng District, Arunachal Pradesh, have been used by the other accused persons in order to park their amount by transferring money to the above Account Nos. of the accused person and the record shows that the said amounts so transferred and parked in the account of the accused person, has been subsequently transferred to the respective Account Nos. of the other accused persons. 4. The learned Spl. P.P., ACB, further submits that from the above, it indicates that the involvement of the accused was minimal in the instant case. Further, during the investigation, the investigating officer has seized all the relevant documents from the present accused person and also recorded his statement. It is further submitted that since the accused is cooperating with the investigation of the case, his further custodial interrogation/detention is no longer required. 5. The learned Spl. P.P., ACB, has, therefore, submitted that he has no objection if the accused is granted bail with certain conditions to ensure his cooperation to the investigation. 6. In view of the submissions made by the learned Spl. P.P., ACB, and on considering the fact that the accused has been in custody for 28 days and he is cooperating with the investigation of the case; his further custodial interrogation/detention appears to be no longer required at this stage. In view of the above, this Court is of the considered opinion that the accused is entitled to be released on bail. Page No.# 3/3 7. Accordingly, the accused Shri Yayo Yangfo, shall be released on bail in connection with ACB Police Station Case No. 13/2025, registered under Sections 61/336/318/316(5)/319 BNS, 2023, read with Sections 7/13(1)(a)(b)/2 of the PC Act; on furnishing a bail bond of Rs. 50,000/-(Rupees fifty thousand) only with one surety of like amount to the satisfaction of the learned Special Judge, PCA, Yupia, subject to the following conditions: (i). that he shall cooperate and appear before the Investigating Officer of the case as and when called for; (ii). that he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and (iii). that he shall not leave the jurisdictional police station without prior permission of the Court. 8.
