JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 08-07-2026 1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Barabar Tourism P.S. Case No.69 of 2025 instituted under Section 309(4) of the B.N.S., 2023. 3. As per the prosecution case, it is alleged that on 23.06.2025 at about 12:30 A.M., 3-4 unknown persons all of a sudden entered into the informant’s room and tied his eyes and then took 17,000/- rupees kept in a nearby bag. When they went away, he came outside and saw his sister Usha Devi’s eyes were also tied and her gold chain valuing approximately one lac rupees, gold studs were also taken away. It is further alleged that upon searching the house he found that locker was open and Rs. 2,80,000 was missing along with valuable ornaments of his Patna High Court CR. MISC. No.42238 of 2026(2) dt.08-07-2026 2/3 sister. The valuables kept in a bag were also taken away by the accused persons. 4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case only on the basis of confessional statement made by the co- accused Sonu Kumar @ Kaila. There is no recovery of stolen articles from the conscious possession of the petitioner. Petitioner is an immediate neighbour of the informant who had assisted the informant’s family in informing the police regarding the incident but due to ulterior motive his name has been implicated in this case by the co-accused. He further submits that petitioner has no criminal antecedent and he undertakes to cooperate in the trial and investigation of the case. There is no chance of absconding of him or tampering with the evidence. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail. 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the clean antecedent of the petitioner, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like Patna High Court CR. MISC. No.42238 of 2026(2) dt.08-07-2026 3/3 amount to each to the satisfaction of the learned J.M. 1st Class, Jehanabad in connection with Barabar Tourism P.S.
