JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners - accused Nos.1 to 4 in Crl.P.No.7537/2026, are the wife and her family members, are before this Court calling in question registration of a crime in Crime No.158/2026, pending before the XXXI Additional Chief Judicial Magistrate, Bengaluru City, for the offences under Sections 115(2), 118(1), 351(2), 3(5) and 352 of the BNS, 2023 and petitioners – accused Nos.1 to 3 in Crl.P.No.7538/2026 are the husband and his family members call in question registration of a crime in Crime No.52/2026, pending before the XXXII Additional Chief Metropolitan Magistrate, Bengaluru City, for the offences under Sections 85, 115(2), 351(2), 352 r/w. 3(5) of the BNS, 2023. Heard Sri Bipin B.S., learned counsel for the wife, Sri K. Nageshwarappa, learned High Court Government Pleader for respondent No.1 – State and Sri Vinod Kumar M., learned counsel for the husband. 3. Learned counsel for the petitioners and respondent No.2 in both the petitions would submit that during the pendency of these petitions, the parties to the lis have arrived at settlement and the couple have reunited. They have also filed joint memos, affidavits of the complainants in both the petitions. 4. The joint memo filed in Crl.P.No.7537/2026, reads as follows: ““1. The above Criminal Petition has been filed by the Petitioners seeking quashing of FIR in Crime No. 158/2026 dated 09 04 2026 came to be registered by Bagalagunte Police Station for the offences punishable under Sections 115(2), 118(1), 351(2), 3(5) and 352 of the Bharatiya Nyaya Sanhita, 2023. 2. Due to matrimonial differences between Petitioner No.2 - Smt Vidya and Respondent No.2 - certain disputes arose, which led to filing of the said complaint and registration of the above FIR. 3. With the intervention of elders, relatives and well wishers, the parties have amicably resolved all their disputes. Petitioner No.2 and Respondent No.2 have decided to continue their marital relationship and live together as - 7 - HC-KAR NC: 2026:KHC:29841 CRL.P No. 7537 of 2026 C/W CRL.P No. 7538 of 2026 husband and wife in a separate, independent residence, away from other family members. It is agreed between the parties that: a) Petitioner No.2 and Respondent No.2 shall reside together in a separate residence of their choice; b) The family members of both sides, shall not interfere in the day to day matrimonial life and domestic affairs of the couple; 4. Respondent No.2 submits that in view of the settlement and reunion, she does not wish to proceed with the criminal case in FIR in Crime No. 158/2026 dated 09 04 2026 came to be registered by Bagalagunte Police Station for the offences punishable under Sections 115(2), 118(1), 351(2), 3(5) and 352 of the Bharatiya Nyaya Sanhita, 2023 against the Petitioners any further, and she has no objection if the said FIR and all further proceedings arising therefrom are quashed by this Hon'ble Court. 5. The parties state that the dispute is purely matrimonial and personal in nature, and in view of the compromise, continuation of criminal proceedings would serve no useful purpose and would amount to abuse of the process of law. The parties therefore jointly pray that this Hon'ble Court may be pleased to: Quash the FIR in Crime No. 158/2026 dated 09 04 2026 came to be registered by Bagalagunte Police Station for the offences punishable under Sections 115(2), 118(1), 351(2), 3(5) and 352 of the Bharatiya Nyaya Sanhita, 2023, and all further proceedings arising therefrom, insofar as the Petitioners are concerned; and Pass such other order or orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice and equity.” 4.1. The joint memo filed in Crl.P.No.7538/2026, reads as follows: “1. The above Criminal Petition has been filed by the Petitioners seeking quashing of FIR in Crime No. 0052/2026 - 8 - HC-KAR NC: 2026:KHC:29841 CRL.P No. 7537 of 2026 C/W CRL.P No. 7538 of 2026 registered by North Women Police Station, Bengaluru, for the offences punishable under Sections 85, 115(2), 351(2), 352 read with 35 of the Bharatiya Nyaya Sanhita, 2023, and Sections 3 and 4 of the Dowry Prohibition Act, 1961, now pending before the 32nd Additional Chief Metropolitan Magistrate, Bengaluru. 2. Due to matrimonial differences between Petitioner No.1 - Sri. Bhuvan S and Respondent No.2 - Smt. Vidya C certain disputes arose, which led to filing of the said complaint and registration of the above FIR. 3. With the intervention of elders, relatives and well wishers, the parties have amicably resolved all their disputes. Petitioner No.1 and Respondent No.2 have decided to continue their marital relationship and live together as husband and wife in a separate, independent residence, away from other family members. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petitions are disposed. (ii) The impugned Crime No.158/2026, pending before the XXXI Additional Chief Judicial Magistrate, Bengaluru City, in Crl.P.No.7537/2026 and the impugned Crime No.52/2026, pending before the XXXII Additional Chief Metropolitan Magistrate, Bengaluru City, in Crl.P.No.7538/2026, stand quashed.
