The petitioner is apprehending his arrest in connection with Bengabad P.S. Case No. 73 of 2026, registered for the offence under Sections 115(2), 109(1), 62, 352 and 351(2)(3) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Giridih. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case and allegations are made that the petitioner has thrown the informant and pursuant to that injury has been received. He next submits that the said allegation is dated 02.05.2026 and the alleged axe is said to be recovered on 02.05.2026 however, the FIR has been lodged on 07.05.2026. He also submits that the petitioner is having no criminal antecedent as disclosed in para 14 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of assault. 5. Considering that the alleged occurrence is said to be dated 02.05.2026 and it has also been stated that the alleged axe has been recovered on 02.05.2026 however, the FIR has been lodged on 07.05.2026 and the petitioner is having no criminal antecedent as disclosed in para 14 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of 2026:JHHC:25522 his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Bengabad P.S. Case No. 73 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 24.08.2026 Anit Uploaded 27.08.2026
