Affidavit of service filed in Court today is taken on record. 2. The petitioner claims to be the widow of a deceased employee who was serving in the Eastern Coalfields Limited (ECL), Pandabeswar Area and expired on 25th June, 2008. 3. The petitioner submits that immediately after the death of her husband, she applied for compassionate appointment which stood rejected. 4. The petitioner applied for payment of Monthly Monetary Cash Compensation on completion of forty five years of age in the year 2020, the same is alleged to be kept pending. 5. Learned advocate representing ECL submits, upon instruction that, the petitioner will not be eligible for receiving the Monthly Monetary Cash Compensation. Page 2 6. Upon hearing the submission made on behalf of both the parties and on perusal of the documents annexed to the writ petition, it appears that no formal order has been passed by the authority upon consideration of the petitioner’s prayer for grant of Monthly Monetary Cash Compensation. 7. Accordingly, the instant writ petition is disposed of by directing the General Manager, Eastern Coalfields Limited, Pandabeswar Area, being the respondent no. 5 herein to take a decision on the petitioner’s prayer seeking grant of Monthly Monetary Cash Compensation on and from the next date of death of her husband strictly in accordance with the provision of NCWA at the earliest but positively within a period of twelve weeks from the date of communication of this order. 8. If the petitioner’s prayer is allowed, then necessary consequential steps shall be taken by the authority without any further delay. 9. Learned advocate for the petitioner is directed to forward a copy of the representation along with all supporting documents to the aforesaid respondent at the time of communicating the order of this Court. 10. It is made clear that this Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation. 11.
