The petitioner is aggrieved by the action of the Block Land & Land Reforms Officer in mutating the name of the respondent Nos.5 and 6 in respect of a plot of land which the petitioner claims to be the owner thereof. The learned advocate appearing for the petitioner submits that the plot in question was mutated in favour of the respondent Nos.5 and 6 without giving any opportunity of hearing to the petitioner. Mr. Bhattacharyya, learned Senior Standing Counsel raised an objection as to the maintainability of this writ petition in view of the alternative and efficacious remedy available under the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. After going through the averments made in the writ petition and the reliefs claimed therein, this Court finds that the petitioner is aggrieved by an action of an authority under the West Bengal Land Reforms Act, 1955, which is a specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997.

In view of the availability of alternative and efficacious remedy under the 1997 Act, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition stands dismissed as not entertained. It is however, made clear that this order shall not preclude the petitioner from approaching the proper forum for appropriate relief in accordance with law. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
