The primary grievance of the petitioner is that no date of hearing of an appeal preferred by the petitioner under Rule 51 of the West Bengal Minor Minerals Concession Rules, 2016 filed on January14, 2026 has been fixed till date. Mr. Saha, learned advocate appears for the respondent no.3. The learned advocate for the State submits that the pending appeal shall be disposed of by the Appellate Authority within the time limit as may be fixed by this Court. Since the appeal under Rule 51 of the 2016 Rules has been filed by the petitioner on January 14, 2026 challenging the order dated September 2, 2025 passed by the District Magistrate, Paschim Bardhaman in Misc. Case No.8/MM of 2025, and the same is still pending, WPA 2 12341 of 2026 stands disposed of by directing the Divisional Commissioner, Burdwan Division, being the respondent no.6 to fix a date of hearing immediately and to make an endeavour to dispose of the appeal by passing a reasoned order as expeditiously as possible but positively within a period of 4 weeks from the date of receipt of a server copy of this order. It is however, made clear that this Court has not entered into the merits of the claim made by the petitioner in the said appeal and all points are left open to be decided by the Appellate Authority in accordance with law and after affording an opportunity of hearing to the petitioner and/or any other affected party. The Appellate Authority is directed to communicate the reasoned order to the petitioner within the time limit as mentioned hereinbefore. There will be no order as to costs.
