Mr. Biswajit Manna … for the Petitioner(s) Mr. Somnath Adhikary … for the State-respondent(s) Mr. Ganguly, learned Senior advocate, appearing for the petitioner submits that the petitioner is renewing his prayer for bail as there has been no progress in the case. The petitioner is in custody since 2nd April, 2025 and only charges have been framed. Learned advocate added that the prosecution has relied upon 45 witnesses in order to prove its case, as such, there is no possibility of the trial being concluded in the near future. Therefore, learned advocate prays that the petitioner may be released on bail. Mr. Somnath Adhikary, learned advocate, appears for the State as per the direction of this court. His appearance may be regularized by the concerned authority. 2 Learned advocate for the State produces the case diary wherefrom it reflects the complicity of the present petitioner. However, at this stage, I do not intend to enter into the merits of the case, as, witness action is about to commence. So far as the evidence of the seizure list witnesses is concerned, the learned trial court within a month from the next date fixed will try to exhaust the same. The petitioner will be at liberty to approach this court after the evidence of the seizure list witnesses is over. Having considered the stage of the case, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.
