R2 : Ms.J.Vidya J U D G M E N T The appellant is accused No.1 in Crime No.52 of 2026 on the file of Cumbum Police Station. He was arrested on 25.01.2026 for the offence punishable under Sections 296(b), 351(3), 109(1) of BNS, 2023 and Section 3(1)(r), 3(1)(s) and 3(2)(v) of SC/ST (POA) Act,
1989. The application filed by this appellant in Crl.MP.No.67 of 2026 for bail before the Sessions Judge, Special Court for trial of cases under SC/ST (POA) Act, Theni was dismissed on 18.03.2026. Challenging the same, the appellant has preferred this Criminal Appeal. 2.During the course of hearing, the defacto complainant has produced a photograph of this petitioner with Aruval. Crl.A(MD)No.380 of 2026 counsel appearing for the appellant has attempted to project his defence that the defacto complainant has abused his mother, who is mentally ill and therefore, A1 has assaulted him with a bucket. The
learned counsel further submits that the defacto complainant is a kick boxer, running a Self-defence training Center along with A2 at Cumbum and therefore, it is not possible for this appellant to assault the defacto complainant, who is a kick boxer. He also submits that the defacto complainant has abused the mothers of some children, who are learning self-defence courses with him and therefore, he is having so many enemies and this occurrence might have been taken place through those enemies. 3.The learned Government Advocate (Crl.side) appearing for the first respondent has raised objection that the investigation in Crime No.52 of 2026 is still pending. Crl.A(MD)No.380 of 2026 4.This Court considered the rival submissions made and also perused the materials placed on record. 5.From the photographs submitted by the defacto complainant, it is revealed that the injuries sustained by the defacto complainant is grievous in nature. Though this appellant is in jail for the past 75 days, this Court is not inclined to grant bail to him. Considering the averments raised by this appellant as against the defacto complainant, this Court is of the view that the investigation has to be conducted on those averments as well.
6. Considering the photographs produced by the defacto complainant, this Court is not inclined to grant bail to this appellant for the present.
