JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 29-06-2026 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners have prayed for bail in connection with Semra P.S. Case No. 05 of 2026 registered for the offence punishable under Sections 103(1), 238 and 3(5) of the B.N.S., 2023. 3. The case of the prosecution, in short, is that one Archana Devi (deceased) was married to Chandra Shekhar Yadav 9-10 years ago. It is alleged that she was being killed by her in- laws and the body was cremated without informing the informant. 4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have Patna High Court CR. MISC. No.40978 of 2026(2) dt.29-06-2026 2/2 committed no offence. They have been falsely implicated in this case. He also submits that from perusal of the FIR, it is clear that the nature of the allegation is general and omnibus. He further submits that the petitioners are father-in-law and mother-in-law of the deceased. The main thrust of allegation is against the husband. He further submits that a statement has been made in para 3 of the petition that petitioners have no criminal antecedent and Chand Yadav @ Rajbansi Yadav and Marachi Devi @ Gangajali Devi are languishing in judicial custody since 25.01.2026 and 11.03.2026 respectively. 5. The application for bail is opposed by learned APP for the State. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Semra P.S.
